The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of the Province of Ontario, Canada. These terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, and you submit to the non-exclusive jurisdiction of the courts located in Toronto, Ontario for the resolution of any disputes. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

E-Commerce / Purchase Terms

Pricing & Currency

All prices displayed on AdriArt.ca are listed in Canadian Dollars (CAD). Prices are subject to change without notice. No taxes are applied to purchases at this time. It is the buyer’s responsibility to determine whether any applicable taxes, duties, or import fees apply to their order, particularly for international purchases.

Payment Methods

We accept the following payment methods through our secure payment processor, Stripe:

  • Visa
  • Mastercard

All payments are processed securely through Stripe. AdriArt does not collect, store, or have access to your full credit card number at any time. For details on how Stripe handles your payment data, please see Stripe’s Privacy Policy.

Order Acceptance & Rejection

Placing an order on AdriArt.ca constitutes an offer to purchase. An order confirmation email does not constitute acceptance of your order. We reserve the right to accept or decline any order, in whole or in part, for any reason, including but not limited to:

  • Product unavailability
  • Errors in pricing or product descriptions
  • Suspected fraudulent activity
  • Inability to verify payment information

If we cancel or decline your order, you will be notified by email and a full refund will be issued to your original payment method.

Product Descriptions & Accuracy

We make every effort to display our artwork and products as accurately as possible, including colors, dimensions, and materials. However, please note:

  • Color accuracy: Due to variations in monitors, screens, and display settings, actual colors may differ slightly from what appears on your device
  • Dimensions: All artwork dimensions are approximate unless otherwise stated
  • Handmade/original work: Each piece is handmade and/or original. Minor variations in color, texture, or appearance are inherent to the artistic process and are part of each work’s unique character — these are not considered defects
  • Prints & reproductions:  Prints are produced using high-quality printing methods. Slight variations between prints and the original artwork may occur

If a product is listed with an error in price or description, we reserve the right to correct the error and cancel any orders placed at the incorrect price, with a full refund issued.

Shipping & Delivery

  • Orders are typically processed and shipped within 3–5 business days of payment confirmation
  • Custom or commissioned works require 6-7 weeks — specific timelines will be communicated at the time of order

Shipping Terms

  • All orders are shipped via Canada Post
  • Tracking information will be provided by email once your order has shipped
  • Risk of loss and title for items pass to you upon delivery to the shipping carrier
  • AdriArt is not responsible for delays caused by the shipping carrier, customs processing, weather events, or other circumstances beyond our control

International Orders

  • International buyers are responsible for all customs duties, import taxes, and brokerage fees imposed by their country. These charges are not included in our pricing or shipping costs
  • AdriArt is not responsible for packages held, delayed, or seized by customs

Undeliverable Packages

  • If a package is returned to us due to an incorrect address provided by the buyer, the buyer is responsible for additional shipping costs to re-send the order

Returns, Refunds & Cancellations

Original Artwork – No Returns

Due to the unique nature of original artwork, all sales of original pieces are final. We do not accept returns or issue refunds on original artwork except in the case of damage during shipping (see “Damaged or Incorrect Items” below).

Prints & Reproductions

Returns are accepted within 14 days of delivery, provided the item is in its original, undamaged condition and packaging. To initiate a return, contact us at [email protected] with your order number.

Custom & Commissioned Work

  • All custom and commissioned artwork is non-refundable once production has begun
  • If applicable: A non-refundable deposit of 30% is required to begin work on commissioned pieces
  • Specific terms for commissioned work will be agreed upon in writing before work begins

Cancellations

  • Orders may be cancelled within 24 hours of placement, provided the order has not yet shipped
  • To request a cancellation, contact us immediately at [email protected] with your order number
  • If the order has already shipped, the return policy above will apply

Refund Processing

  • Approved refunds will be processed to the original payment method within 5–10  business days of approval
  • Shipping costs are non-refundable unless the return is due to our error or a damaged/defective item
  • Original shipping costs will be deducted from refunds where applicable

Damaged or Incorrect Items

If your order arrives damaged or you receive the wrong item, please contact us within 7 days of delivery at [email protected] with:

  • Your order number
  • A description of the issue
  • Photographs of the damage and/or incorrect item(s)
  • A photograph of the packaging (for shipping damage claims)

Upon review, we will offer one of the following at our discretion:

  • A replacement item (subject to availability)
  • A full refund, including original shipping costs
  • A partial refund or credit

If the item was damaged during shipping, we may need to file a claim with the shipping carrier. Your cooperation in providing documentation may be required.

CASL Compliance

Our practices regarding commercial electronic messages comply with Canada’s Anti-Spam Legislation (CASL). For full details on how we handle consent, unsubscribe requests, and sender identification, please refer to our Privacy Policy.

Termination

We may, at our sole discretion, suspend or terminate your access to the website and its services, with or without notice, for conduct that we believe violates these Terms and Conditions or is harmful to other users, us, or third parties, or for any other reason.

Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall otherwise remain in full force and effect.

Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and AdriArt.ca regarding your use of this website, superseding any prior agreements.

Force Majeure

AdriArt shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, acts of government, internet or telecommunications failures, shipping carrier delays, or supplier shortages.

Age Requirement

You must be at least 18 years of age to make a purchase on this website. By using this website and agreeing to these Terms and Conditions, you represent that you are at least 18 years old, or that you are at least 13 years old and have obtained parental or guardian consent.
